These Terms of Use govern access to and use of the Fitzer app. By creating an account, you declare that you have read and accept this document. The Privacy Policy and the Subscription Terms are separate documents.
1. Company identification
These Terms of Use govern the use of the Fitzer app, provided by Fitzer Tecnologia Ltda., a private legal entity registered under CNPJ 68.056.855/0001-78, with registered office at Rua Dona Carmelita Gama Romeiro, nº 300, Parque São Benedito, Pindamonhangaba/SP, CEP 12.410-200, Brazil, hereinafter referred to as "Fitzer".

2. Purpose of the app
Fitzer is a digital platform for tracking habits, wellbeing, physical activity and fitness, intended exclusively for people aged 18 or over. The app can be used independently of any weight management medication or medication in the GLP-1 class.
Fitzer brings together, in a single place, features for recording and tracking food, hydration, workouts, weight, body measurements, body composition, progress photos and personal goals, including weight loss, weight maintenance, muscle gain, body recomposition and improved fitness.
For users who take medication, the app may also offer specific features for recording injections, doses, symptoms, injection sites, stock and reminders. These features are optional and are not required to use the rest of Fitzer.
Fitzer is an informational tool for personal organisation and habit tracking. The estimates, automated analyses, reminders and other information provided by the app do not constitute a medical, nutritional or professional diagnosis, prescription or advice, and do not replace care from qualified professionals.
3. No promise of results
Fitzer does not promise weight loss, muscle gain, treatment, cure or any health outcome. Results vary according to individual factors.
4. Eligibility and minimum age
Fitzer is intended exclusively for people aged 18 or over. Creating or keeping an account in the name of someone under 18 is not permitted.
Fitzer processes health and wellbeing data. If we identify that an account belongs to someone below the minimum age, it may be suspended or terminated.
5. Creating and securing your account
Access to the app requires creating an account, authenticated through the platform’s authentication provider. You undertake to provide truthful information at sign up and to keep it up to date.
You are responsible for keeping your account credentials confidential and for all activity carried out in your account. Contact the support channel immediately about any unauthorised use or suspected compromise of your account.
6. Information you provide
You are responsible for the accuracy of the information you enter in Fitzer, including profile data, weight, measurements, medication doses, symptoms, meals and photos.
Fitzer does not clinically validate the information you enter; it uses that information to calculate estimates and organise your tracking.
7. Permitted use
Fitzer may be used only for personal purposes, to track your own habits, food, workouts, wellbeing and, when you choose to use those features, your medication, in accordance with these Terms of Use.
8. Prohibited conduct
The following are prohibited: providing false information at sign up or in any record in the app; attempting to access other people’s accounts without authorisation; exploiting faults, vulnerabilities or unintended behaviour of the app; attempting to circumvent quotas, plan limits or usage controls; carrying out unauthorised reverse engineering of the app or its features; using automation, bots or scripts to interact with Fitzer outside normal use through the interface; committing fraud; publishing illegal content; harassing, threatening or embarrassing other people in challenges, groups or rankings; making unauthorised commercial use of the app or its content; and infringing third party rights, including copyright and image rights.
Breaching these rules may lead to suspension or termination of the account.
9. Content you upload
User content is all material you upload to Fitzer, including photos, text, measurements and other records. You own that content, and Fitzer claims no ownership of it.
You grant Fitzer only the licence strictly necessary to store, process and display that content to you, and to other participants when you choose a social feature, for the purpose of operating the feature you requested. This licence is not a broad or unrestricted assignment of ownership of your photos or any other content, and it ends when the content is deleted or the account is deleted, subject to the technical and legal retention described in the Privacy Policy.
10. Photos
The app allows photos to be uploaded for different purposes: profile picture; meal photos, captured with the device camera or selected from the gallery, used to estimate food information; progress photos, captured with the camera or selected from the gallery; and body photos, used in body analysis.
Each type of photo is stored in its own private space, reachable only by you, as described in the Privacy Policy. The rules on capacity and cycle quota are in the Subscription Terms.
11. Food
Fitzer lets you record meals manually, by barcode or by photo, and track daily progress on calories, protein and water against the goals set in your profile.
The food database used for the calculations combines public and regional sources. The nutritional values shown are estimates and may not correspond exactly to the real composition of each food.
12. Workouts
Fitzer organises workout plans and lets you record completed sessions. Workout suggestions do not replace assessment by a qualified fitness professional.
Stop the activity and seek appropriate guidance whenever there is risk, pain or worrying symptoms.
13. Weight and measurements
The app lets you record weight and body measurements over time and view the trend against your goal.
By default, Fitzer avoids highlighting the weight number at all times, prioritising habits and wellbeing.
14. Medication and symptoms
Fitzer lets you record dose, time and injection site of medication, as well as symptoms noticed during treatment, to support your personal organisation.
The information recorded in the app does not replace assessment by your doctor and must not be used as the sole basis for decisions about dose or continuing treatment. In urgent situations, seek appropriate health services immediately.
15. Menstrual cycle
The menstrual cycle module is optional, turned on and off by you at any time.
16. Body analysis
Body analysis is an automated visual analysis of body photos, supported by artificial intelligence, to observe progress over time.
It is available only on the Plus plan, with a minimum interval of seven full days between analyses. It is not a diagnosis and does not assess any health condition. The image does not automatically enter your gallery: you decide whether to save it.
17. Artificial intelligence
Fitzer uses artificial intelligence to recognise foods and estimate food information from meal photos, and for body analysis. Processing happens through a dedicated backend function: the app never communicates directly with the artificial intelligence provider, and the access key exists only in the backend.
The artificial intelligence provider is Google, and the model used is Gemini 2.5 Flash. Details about which data is sent and how to decline optional features are in the Privacy Policy.
The Free plan does not use artificial intelligence features.
Every estimate generated by artificial intelligence is a suggestion. You always review and confirm the result before it is saved to your diary.
18. Limits of the estimates
Nutritional values, calorie estimates, workout suggestions and body analysis observations are approximations and may contain inaccuracies. They have no diagnostic value and must not guide clinical decisions on their own.
19. Challenges, duels, groups and rankings
Fitzer offers social features, such as challenges, duels, groups, achievements and rankings, on the Free plan as well. Taking part is always optional.
In those features, part of your activity may be visible to other participants, as described in the Privacy Policy. You agree to behave respectfully and not to use offensive, discriminatory or misleading names, avatars or messages. Publishing other people’s health data in any shared space in Fitzer is prohibited.
20. Service availability
Fitzer aims to keep the service available but does not guarantee uninterrupted operation. Connectivity failures, maintenance or unavailability of third party services may temporarily affect a feature.
Temporary unavailability may occur, without prejudice to the rights guaranteed by applicable law.
21. Updates and changes to the service
The app may be updated periodically to fix faults, improve features and adapt to new versions of your device’s operating system.
Features may be added, changed or discontinued over time, always respecting the rights already guaranteed to you by these Terms of Use and by the Privacy Policy in force at the time of each change.
22. Third party content
Fitzer may reference third party databases and services, such as food databases, to compose its estimates. Fitzer Tecnologia Ltda. is not responsible for the accuracy of data provided by those external sources.
23. Intellectual property and use of the brand
The Fitzer app, its brand, design, code and texts are the property of Fitzer Tecnologia Ltda. or of authorised licensors, protected by applicable intellectual property law.
Fitzer Tecnologia Ltda. grants you a personal, limited, non exclusive and revocable licence to install and use the Fitzer app, exclusively for the purposes set out in these Terms of Use. The Fitzer name, logo and other brand elements may not be used by third parties without prior written authorisation.
24. Suspension and termination
Fitzer Tecnologia Ltda. may suspend or terminate access to an account in the event of a breach of these Terms of Use, without prejudice to other applicable measures.
If Fitzer Tecnologia Ltda. decides to discontinue Fitzer permanently, users will be notified with reasonable notice, and information about exporting their data before the shutdown will be made available.
25. Account deletion by the user
You may request deletion of your account at any time, directly in the app, on the account deletion screen, or through an external request as described on the account deletion page of our website. The technical effects of that deletion are described in the Privacy Policy.
26. Limitation of liability
To the maximum extent permitted by applicable law, Fitzer is not liable for health decisions taken solely on the basis of estimates, suggestions or observations generated by the app, without professional care.
Nothing in these Terms excludes or limits rights that cannot be legally waived.
27. Plans and subscription
Fitzer offers the Fitzer Free plan, permanently free, and the Fitzer Plus plan, which is the paid plan of the app.
The conditions of each plan, including features, limits and quotas, are in the Subscription Terms, which form part of these Terms of Use.
27.1. Advertising
Fitzer Free is the permanently free plan of the app and may be funded by displaying advertising, including banners and videos.
Advertising is not active yet and will only start to be displayed after the corresponding platform is implemented and the applicable documentation is updated beforehand.
Fitzer Plus is the paid plan of the app and will be offered without advertising.
28. Future features and integrations
Fitzer may make available new features and integrations with wearable devices, smartwatches, health apps and third party services. Availability may vary according to operating system, device, country, app version and permissions granted by the user.
Future features are only considered available once they are actually switched on in the app. References to planned features do not represent a promise of release, a guarantee of compatibility or an obligation to make them available within any set period.
29. Changes to these Terms
These Terms of Use may be updated. Material changes, which alter relevant rights or obligations, may require new acceptance before continued use of the app. Editorial corrections, with no impact on rights or obligations, do not require new acceptance.
The version in force and the version history are available in the legal information area of the app and on the Fitzer website.
30. Communications
Fitzer may send communications relating to your account, to app security and to these Terms of Use through the channels available in the app.
31. Governing law and jurisdiction
These Terms of Use are governed by the laws of the Federative Republic of Brazil.
The courts of the user’s domicile are elected to settle disputes arising from these Terms where consumer legislation applies. In other cases, the jurisdiction rules of Brazilian procedural law apply.
